3RICTION SMP Terms of Service

By purchasing any product from the 3RICTION SMP store, accessing our Minecraft server, Discord server, website, or any related services, you agree to the following Terms of Service (“Terms”). If you do not agree to these Terms, do not purchase any products or use our services. 

1. General Disclaimer: 

3RICTION SMP is an independent Minecraft server and is not affiliated with or endorsed by:

All purchases are voluntary donations made in exchange for digital in-game perks, ranks, or services. 

2. Nature of Digital Goods: 

All products sold are:

  • Virtual, digital items.
  • Delivered electronically.
  • Intended solely for use on 3RICTION SMP.

These items have no real-world cash value and cannot be redeemed for money!

3. Delivery of Purchases: 

Most purchases are delivered automatically within minutes.

Delivery may be delayed due to:

  • Server outages.
  • Payment verification.
  • Plugin errors.
  • Maintenance.

If you do not receive your purchase within 24 hours, contact our support team.

All packages require the player to be online to receive items! 

5. No Refund Policy: 

ALL SALES ARE FINAL.

Due to the nature of digital goods:

  • No refunds will be issued.
  • No chargebacks are permitted.
  • No partial refunds are available.

This applies regardless of:

  • Whether you used the item.
  • Whether you are later banned.
  • Whether the server shuts down.
  • Whether you stop playing. 

6. Chargebacks and Payment Disputes 

If a chargeback or payment dispute is initiated:

  • Your account may be permanently banned.
  • All purchased items may be revoked.
  • We may dispute the chargeback with payment processors.
  • Additional recovery fees may be pursued where permitted by law.

7. Server Changes and Closures: 

We reserve the right to:

  • Modify, rebalance, or remove any item or perk.
  • Change prices at any time.
  • Reset the server.
  • Wipe player data.
  • Suspend or permanently shut down the server.

No refunds will be issued for any such changes.

8. Rank and Package Modifications: 

Features included with ranks or packages may change at any time for balancing or operational reasons.

Examples:

  • Commands may be added or removed.
  • Gem multipliers may change.
  • Cosmetic perks may be adjusted.

Purchases grant access to current and future versions of a package, not any permanently fixed set of features.

9. Bans and Punishments: 

Purchasing items does not exempt you from server rules.

If you are banned:

  • You may lose access to all purchased items.
  • No refunds will be issued.
  • Staff decisions are final.

10. Instant Unban purchases:

  • Remove only your current active ban.
  • Do not guarantee immunity from future punishments.
  • May be revoked in cases of fraud or abuse.

We reserve the right to deny unban purchases in exceptional circumstances, including payment disputes.

11. Abuse of Store Purchases: 

We may revoke any purchase without refund if we believe you:

  • Exploited bugs.
  • Used hacked clients.
  • Attempted to duplicate items.
  • Shared purchased benefits in unauthorized ways.
  • Engaged in fraud or malicious conduct.

12. No Guarantees:

We make no guarantees regarding:

  • Server uptime.
  • Feature availability.
  • Compatibility.
  • Performance.
  • Player population.
  • Future updates.

All services are provided “as is” and “as available.”

13. Limitation of Liability: 

To the maximum extent permitted by law, 3RICTION SMP and its owners, staff, affiliates, and partners are not liable for:

  • Data loss.
  • Account loss.
  • Gameplay interruptions.
  • Lost profits.
  • Lost opportunities.
  • Indirect or consequential damages.

Our maximum liability shall not exceed the amount paid by you in the preceding 30 days.

14. Indemnification: 

You agree to indemnify and hold harmless 3RICTION SMP and its staff from any claims, damages, liabilities, and legal costs arising from:

  • Your use of the server.
  • Your breach of these Terms.
  • Your violation of any laws or third-party rights.

15. Usernames and Account Responsibility: 

You are solely responsible for:

  • Entering the correct Minecraft username.
  • Securing your account.
  • Preventing unauthorized purchases.

We are not responsible for purchases sent to the wrong account.

17. Fraud Prevention

We reserve the right to:

  • Verify purchases.
  • Delay fulfillment.
  • Cancel suspicious transactions.
  • Request additional information.

Fraudulent purchases may be reported to payment processors and authorities.

19. Third-Party Services: 

Our services may rely on third-party providers such as Tebex, Mojang, Discord, and hosting companies.

We are not responsible for outages or issues caused by third parties.

20. Force Majeure: 

We are not liable for delays or failures caused by events beyond our control, including:

  • Cyberattacks.
  • Power outages.
  • Internet disruptions.
  • Natural disasters.
  • Government actions. 

21. Amendments:

We may update these Terms at any time without prior notice.

Continued use of our services after updates constitutes acceptance of the revised Terms.

By making a purchase or using our services, you confirm that:

  • You agree to be legally bound by them.
